Terms and Conditions

Creating an Account, Logging in and placing orders constitutes acceptance of all terms and conditions stated below. References to RedMoby and Health Mobius herein after refers to Health Mobius Development and its affiliates.

SALES TERMS

This website is for Wholesale sales only.

All customers must provide Sales Tax Resale Number indicating exempt status.
All customers must provide Federal Identification Number.
All merchandise sold with the intention of resale by the purchaser.
All customers must provide verification and validation that the customer’s business is an industry-related business in good standing.

Health Mobius does not require a minimum order. However, you must maintain an adequate level of purchases and activity to maintain your wholesale account and benefit from wholesale pricing levels

Generally, orders are shipped within 1-2 business days. Exclusions could include, but are not limited to:

• Out of stock products
• Items drop shipped from the manufacturer
• Special orders

PAYMENT TERMS

We accept credit card payment at time of order. Unless otherwise agreed upon, we do not store credit card information or keep credit card information on file. Each time an order is placed on our website, you will need to provide credit card payment and shipping information.

Major credit cards are accepted, including Visa, MasterCard, Discover and American Express. A $25.00 charge will be assessed for any chargeback for any reason. You are responsible for any and all collection costs and late payment fees of 2% per month on any and all delinquent balances.

SHIPPING TERMS

Shipments are subject to the carriers’ published shipping rates, accessorial surcharges and other fees as applicable. Additional charges could also be assessed that may include fuel surcharges and dimensional/oversize fees, when required by carriers’ regulations. All such charges as mentioned herein, along with any insurance costs, are calculated and added to the invoice total and are non-refundable.

If an order is refused for any reason, Health Mobius will be compensated for all shipping charges plus a 20% restock fee. Such compensation must be received before any other orders are released for the customer.

All orders are shipped FOB Willowbrook, IL (or the manufacturers’ location for drop ship items). Damages are the responsibility of the carrier once the shipment is delivered to the carrier. Customers must make damage claims directly to the carrier within 10 days of receipt of the order. All boxes and packaging material are necessary when filing a claim. All shipping/pricing discrepancies must be reported within 3 business days of receipt of order.

RETURNS

All products sold by Health Mobius are sold with, to the extent that such warranties exist and are transferable, the manufacturer’s limited warranty. Please read all warranty material carefully as the warranty period, service and transferability varies by manufacturer and product.

All returns require a Return Authorization.

Defective product can be returned to Health Mobius within 14 days of sale. After 14 days, defective product must be returned to the manufacturer, under the specific warranty allowances.

If an item is received damaged or defective, please contact us immediately. Defective returns will be accepted for exchange or repair, at our discretion, within 14 days from the date of purchase. If there is no exchange or repair we have the right to impose up to a 20% restocking fee. No refunds or credit will be granted after 14 days. The terms of the manufacturer’s warranty will still apply - please contact the manufacturer directly.

A product must be diagnosed "defective" by a member of the Technical Support Staff at the manufacturer before we can accept it as a defective return. You can get a list of manufacturer phone numbers by contacting us.

Non-defective product can be returned to Health Mobius within 14 days of sale. Any non-defective returns must be 100% complete in original, unopened packaging and in re-saleable condition, with all packaging, manuals, cables, registration cards, accessories and UPC label and/or unbroken seal. We reserve the right to refuse a return on any product that does not meet these requirements. All non-defective returns will be assessed a 20% restock fee within 14 days of purchase and will only be accepted in resalable condition with all original packaging. Freight charges will not be refunded.

Please call a Health Mobius customer service representative at 1-800-436-1041 for an RA number. Returns without this authorization will not be accepted. RAs are effective for 14 days only.

The RA number must be printed clearly on outside of the carton, and all products must be securely protected in double packaging. If the RA number is not visible, the shipment may be refused. If shipping labels are placed on or RA numbers written on the manufacturer’s boxes, the product will not be in resalable condition, and, in turn, will not be eligible for return. All original packaging and materials must be returned with the product.

All returns must be returned to Health Mobius with freight PREPAID. Damaged and defective product replacements will be sent with no freight expense to the customer.

Upon receipt and acceptance of returned items, Health Mobius will credit the customer’s account for merchandise costs. The Customer is responsible for shipping and handling charges on all returned items.

The following items are not eligible for return:

Special orders, closeout items and discontinued items.
Items for which manufacturers will not accept returns.
Items showing obvious signs of misuse, consumer abuse or commercial use.

Please allow one week for return processing.

Returns will not be accepted 14 days after sale, regardless of reason.

INACTIVE ACCOUNTS

All accounts with no activity for six months or greater can be subject to a monthly service charge.

All accounts with no activity for 12 months or greater will be closed.

MODIFICATONS AND AMENDMENTS

Health Mobius reserves the right to amend at any time any policies governing this Website, including, but not limited to these Terms & Conditions as well as the Payment, Shipping, and Return Policy, by posting the amended terms on the Website. You will be able to tell that a revision has been made by the date of the last revision indicated at the top of the document. The amended terms shall be effective immediately after they are initially posted on this Website. Your use of the Website following the posting of such amended terms shall constitute your acceptance of any such changes. If you do not accept the amended terms, you must cease using this Website.

ADDITIONAL TERMS

Health Mobius has the option to substitute any item on backorder for a comparable item of equal or greater value. Backorders are shipped automatically. Customers must call in advance to cancel a backorder.

Health Mobius is not responsible for typographical errors or erroneous data in publications, Website or any other media platform. Please note that items ordered may not be exactly as pictured.

Prices are subject to change without notice.

Health Mobius reserves the right to limit quantities.

Some product lines have MAP (Minimum Advertised Price) Polices, as stipulated by the manufacturer. These items include Tanita, Polar, Visiball and Epilady. Please call a Health Mobius sales representative for more details.

TRADEMARKS

The Red Moby and Health Mobius name, logos and images are trademarks of Health Mobius. Health Mobius trademarks may not be used in connection with any product or service that is not authorized by Health Mobius, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Health Mobius, its affiliates and its subsidiaries.

All other trademarks and trade names that appear on Health Mobius publications or the Red Moby website, www.redmoby.com, are the property of their respective owners and may not be reproduced, copied or manipulated in any manner without the expressed, written approval of the trademark owner.

All content included on or comprising all Health Mobius publications or the Health Mobius Website including information, data, photographs, videos, typefaces, graphics, music, sounds and other material is protected by copyright, trademark, patent or other proprietary rights, and these rights are valid and protected in all forms, media and technologies existing now or developed in the future. All content is copyrighted as a collective work under the U.S. and international copyright laws, and Health Mobius owns, to the fullest extent allowed by such laws, the copyright in the selection, coordination, arrangement and enhancement of all content.

APPLICABLE LAW

These Website Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois for all purposes, including Websites, use of Services, Interactive Areas and product purchases, without resort to its conflict of law provisions. You agree that any action at law or in equity arising out of or relating to these Website Terms of Use or your use of the Websites shall be filed only in the state and federal courts located in Cook County, Illinois and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of or relating to these Website Terms and Conditions or your use of the Websites.

TERMINATION

Notwithstanding any of these terms and conditions, Health Mobius reserves the right, with or without cause, without notice and in its sole discretion, to terminate your license to use any of the Websites, and to block or prevent future access to and use of any of the Websites.

SEVERABILITY

If any provision of these terms and conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.

Health Mobius believes in protecting customers’ private information. Health Mobius will not give away, sell, rent or lease customers’ personal information to any third party.
